There are four degrees of burglary.
First degree burglary is the breaking and entering of the dwelling of another with the intent to commit theft or a crime of violence. The penalty for this offense is imprisonment for not more than 20 years.
Second degree burglary is the breaking and entering of the storehouse of another with the intent to commit theft, a crime of violence or arson in the second degree. The penalty for this offense is imprisonment for not more than 20 years, and/or a fine of $10,000.
Third degree burglary is the breaking and entering of the dwelling of another with the intent to commit any crime. The penalty for third degree burglary is imprisonment for not more than 10 years.
Fourth degree burglary is the breaking and entering of the dwelling of or the storehouse of another; a person may not be in or on the dwelling or storehouse of another with the intent to commit theft; a person may not possess burglar's tools with the intent to use or permit the use of the tools in the commission of any violation of the burglary subheading. The penalty for this offense is imprisonment for not more than 3 years.
