There are several different types of theft. The most common is Theft -- Obtaining or Exerting Unauthorized Control.
The elements of this offense are: (1) that the defendant took and carried away the property of another, (2) that the defendant did so without the authorization and with the intent of depriving the owner of the property and (3) that the value of the property was at least $300.00 -- the maximum penalty for this offense is imprisonment for not more than 15 years and/or a fine of $1,000.
Theft of property valued at less than $300 is a misdemeanor, punishable by imprisonment for not more than 18 months, and/or a fine of not more than $500, and return the property to its rightful owner or pay him/her the value of the property.
