A weapon encompasses virtually any object which could be used to cause harm to others. The charges are generally divided between openly carried and concealed weapons.
Openly carrying a weapon with the intent to injure must be proven by the following elements: (1) that the defendant did possess a weapon and (2) the defendant possessed the weapon with the intent or purpose of injuring any person in an unlawful manner. The penalty for this offense is imprisonment of not more than 3 years and/or a fine of $1,000.
The carrying of a concealed weapon carries the same penalties, but does not require the element of intent.
