Divided NJ Supreme Court Limits Some Accident Victims’ Ability to Recover

April 4, 2019

On March 26, 2019, the New Jersey Supreme Court decided the case of Haines v. Taft. The Court had certified the following question: “Does N.J.S.A. 39:6A-12 preclude a plaintiff from recovering medical expenses above those collectible or paid under an insured’s PIP provision in a standard automobile insurance policy, including medical expenses exceeding any elected PIP option allowed pursuant to N.J.S.A. 39:6A-4.3(d)?” When the Court finally rendered its opinion, however, its decision did not cover the expanse of the certified question. March 15, 2019

Slip and fall cases are not always as clear cut as they seem. Images from the scene of a structural collapse are vivid, and highlight the sheer force of the event. Cinder blocks and bricks reduced to rubble, clouds of dust, tons of debris scattered in piles, the side-by-side images of what used to be and what is now – all of these images provide a clear understanding of what has happened, without the need for words. However, the collapse itself is not the only thing that can cause injuries to individuals. The aftermath of such a construction accident can be just as damaging. Injuries that Can Arise from Structural Collapse The most obvious injuries from a structural collapse are those resulting from being stuck by or trapped under debris. Injuries include: Broken…

However, there are things that motorists can do to keep themselves safe and give drivers of these tractor trailers every opportunity to be…
