You Might Be Getting More Than You Think From Uber – And Less

When you set up your Uber account, you went through an application, and before it was over, you probably checked a box saying that you agreed to Uber’s Terms of Service. And you’ve probably checked boxes in messages from Uber saying that you agreed to the updated Terms of Service. Did you read those terms? Most people don’t. If you did, did you understand them?

Recently, a judge in Hudson County ruled that three Uber riders whose driver was involved in an accident were bound by Uber’s Terms of Service, even though the riders never agreed to them and didn’t know what they were agreeing to. One of the things they unwittingly agreed to included waiving the right to arbitrate almost any claim they might have against Uber. Their Uber driver came from New York City and had substantially less insurance than New Jersey law requires. When the riders sued Uber, the rideshare company said they couldn’t because of an arbitration provision hidden in the Terms of Service.

So, at least according to one judge, when you accept an Uber ride, you give up your right to go to court and have a jury hear your case.
