Don’t Take a Gamble After Sustaining a Personal Injury in NJ

Sports wagering has been legal in New Jersey now for about a year and a half.  You can download one (or more) of many apps to bet on a game. You can also go to Atlantic City or the racetrack to place a bet. Motor vehicle accident and personal injury cases can sometimes be something of a gamble. There are a lot of variables. Who is at fault? How bad are your injuries? Have you had prior injuries? How much insurance coverage is available? Are you a “good witness”? Some of these things are within your control and some really are not.

Navigating a Rideshare Accident

If personal injury cases can sometimes be compared to a gamble,  the closest you’ll get to a sure thing is being involved in an accident while riding in a so called “transportation network company  vehicle.” In everyday language, “transportation network company” means Uber or Lyft. There are several reasons why Lyft and Uber accidents are pay dirt.

First, as a passenger, the possibility of you having any responsibility for the accident is almost nil. You may want to consider not talking to the Lyft or Uber driver so, in case of an accident, it can’t be said that you were a distraction.

Second, if the Uber or Lyft driver is responsible, New Jersey law requires that rideshare companies provide $1.5 million of insurance coverage.  

Third, if the Lyft/Uber driver is not at fault, New Jersey law requires that rideshare companies also provide $1.5 million in underinsured motorist coverage so it is pretty unlikely that an at-fault driver’s low insurance protection will keep a passenger from collecting her or his just due. The same is true when the at-fault vehicle is uninsured. New Jersey law requires Uber and Lyft to maintain $1.5 million in uninsured motorist coverage.
